And if so how does the use of symbols avert it in future?

Of course there was discrimination.  It was clearly found so under the law, and the company actually admitted it. Don't see the problem. Straight forward really.
Do you have any sex change friends Seadog ?  I know two folk, one to male, one to female. It's an acute area where so much other discrimination is tested, especially given underlying bollux of some people who refuse to accept the law where gender is concerned.
Unisex toilets would be best, as are found in many facilities and public places, even stone age workplaces these days. The law needs to change there.
I'm minded of the historical toilet arrangements of ancient Rome where the lower troops defecated together like today's male urinals, but commissioned chaps defecated in private. Funny stuff eh.

Every toilet at my place of work is unisex, the same as the one in my home.

The difficulties in providing toilets for every possible sexual preference on existing ships are great. Due to design and construction, personally I think he/she was just being vexacious. In a cubicle nobody knows what equipment is being used.

If we're talking vexatious, then I think Obama's "vexatious litigant" Andy Martin takes a lot of beating. What sort of weirdo is he.  Laughing
Some people get off on taking things to court. It could be bollux, it could be a cracked paving flag, it could be an illegal war. Lots of laws we don't agree with. That's how it is. Probably more weirdos in pubs or expensive restaurants though, on average.
There  are a very small number of folk who have borderline physical gender problems that medicine can help with. Hermaphrodites are part of the condition. I'm glad I've not had such problems. Many animal species show the same issues.  Nature gets blurred sometimes.

As an aside, I've often found it interesting that several European languages use masculine and feminine personal pronouns in the plural, while the English language does not follow that rule. Wouldn't be surprised there's an interesting reason behind that, given all our languages tend to have a basis in Latin that is extremely particular about masculine and feminine.
