| Plymouth Argyle manager Carl Fletcher convicted of speed camera offence Argyle manager Carl Fletcher has been convicted of failing to identify the driver of his car when he was being investigated for speeding. Plymouth magistrates were told neither Fletcher nor his wife could remember who was at the wheel of the Audi Q7 at the time. Fletcher, aged 31, who did not attend court, was found guilty in his absence of failing to give information relating to the identity of a driver said to be guilty of an offence on November 13 last year. He was the registered keeper of the Audi which was said to have been photographed exceeding the 30mph speed limit in Alma Road close to Home Park on October 4. Magistrates dismissed the alternative speeding charge. He was fined £525, ordered to pay £60 prosecution costs and £15 victim surcharge. His licence was endorsed with six penalty points. Angela Furniss, for the Crown Prosecution Service, said a notice of intended prosecution was sent to Fletcher’s previous address in Romford, Essex, on October 13. She said police received a call from his wife saying the couple had moved to Manadon in Plymouth and that the notice should be sent there. Mrs Furniss then said Mrs Fletcher rang again to request photographic evidence as they could not remember who was driving the car at the time. She added she was told the identity of the driver was not clear, but it was sent anyway in case it jogged someone’s memory. Mrs Furniss said: “There was a phone call from the defendant’s wife on November 22 saying they did not know whether it was him or her. She was told that as the car was in his name, he had to respond.” She added Fletcher himself later called to say he did not remember who was driving the car. | What is he supose to do? guess, is that how our justice works now and not with prosecuters gathering evidence to secure a conviction. By the sound of it both he and his wife responded telling them they simply did not know, damned if you do and damned if you you don't it seems. I only got a £60 fine and 3 points 4 years ago for doing 87 mph on the A38 at South Brent so I can't help feeling six points harsh.

| not much else he could do really............. admitting the offence & not being certain it was you was driving is perjury surely ?

| He's been done for not knowing/informing who was driving his car, it's the law and prevents people from avoiding speeding fines.

| It is a common misconception that if there is no clear photographic evidence then if you say that you cannot remember who was driving that the case will be dropped.
As is seen here, the case is not dropped and the penalty is increased. The letter you are sent makes clear that if you withold information then you are guilty of perjury. |

| If Fletcher had held his hands up "Fair play guv" he would have got a £60 fine and three penalty points on his licence.End of.However he didn't so tough luck Norman Stanley. |

| who ever it was, they were not driving, all they were doing, as with 80% of today's motorists, they were behind the wheel & speeding, they were caught!! We need more speed camera's in unmarked vehicles, the fact that there are 12 signs stating 30 MPH is warning enough IMO... Perhaps who ever it was behind the wheel will now register for an advance driving course, where they will learn to read the road 500 yards ahead & be in control of their vehicle, i.e they will now be able to adhere to the appropriate speed limits |

| The offence committed on Oct 4th........the plea that they between them didn't know who was driving was on Nov 22nd.
The time of the offence and the road on which it was committed being known plus the the gap of roughly seven weeks between these two dates should not be beyond memory recall.
There is no mention of a six point penalty causing a driving ban for Mr Fletcher......would it have been a problem for Mrs Fletcher ?
Where they naive enough to think that if the driver was not known the case would be dropped ?
As already stated by an earlier poster, that was the quickest 6pts that Fletcher has earned all season.....and no one had to work there socks off to achieve them. |
